Terms and Conditions

  1. Scope

    These Terms and Conditions (T&Cs) govern the use of the tool (hereinafter referred to as "online.dunt.at"), which allows users to upload, modify, and download files. Additionally, they regulate the purchase of software services via the integrated webshop. By using the tool and making purchases, you accept these T&Cs in their current version.

  2. Use of the Tool
    1. The tool enables users to upload files, modify them, and download the edited files.
    2. The use of the tool is permitted for both private and commercial purposes. It is prohibited to use the tool for illegal purposes.
    3. The user is responsible for the content of the files they upload and agrees not to upload any content that violates applicable law or public morals.
    4. The user agrees not to use the tool in a way that could impair its functionality or overload the operator's servers.
    5. The user agrees not to attempt to circumvent any technical limitations of the tool.
    6. The user is responsible for keeping their login data confidential and agrees not to share it with third parties. The sale, transfer, or lending of user accounts without the explicit consent of the operator is strictly prohibited.
    7. The use of the tool is generally permitted in the country specified in the web panel up to 90% of the time. This is based on regional licensing and usage conditions. However, exceptions may apply in border regions, allowing limited use in neighboring countries. The user is responsible for ensuring compliance with the respective national regulations and laws.
    8. License Restrictions - The license to use the tool is limited to a single natural person or a single legal entity (company). It is strictly prohibited to integrate the tool or any part of its functionality – including, but not limited to, the API or integration with WinOLS – into other software products, platforms, or services, whether for internal or external use, resale, or sublicensing. Any use of the tool beyond individual or internal company purposes – particularly integration into third-party software, automated systems, or white-label solutions – is only permitted with the prior express written consent of the operator.
  3. Contract Conclusion

    By placing an order in the webshop, the customer submits a binding offer to conclude a purchase contract. The order confirmation is sent automatically via email. The contract is concluded upon receipt of this confirmation.

  4. Prices and Payment Terms
    1. Unless otherwise stated, all prices include the applicable VAT (Value Added Tax).
    2. The following payment methods are accepted:
      • PayPal
      • Credit card
      • Bank transfer
    3. Payment is due immediately. The order will be processed only after payment is received.
  5. Delivery and Activation

    Software activation is carried out automatically upon receipt of payment. No physical products will be shipped. All services are provided digitally.

  6. Retention of Ownership

    The provided software services remain the property of the operator until full payment has been received.

  7. Right of Withdrawal

    Since the service provided is a digital service, the right of withdrawal expires upon activation, in accordance with Section 356 (5) of the German Civil Code (BGB). By purchasing the software service, you expressly agree that your right of withdrawal is waived once activation has occurred.

  8. Rights to Uploaded Files
    1. The user retains all rights to the files they upload.
    2. By uploading files, the user grants the operator of the tool a non-exclusive, worldwide, royalty-free right to store and process the files for the purpose of modification and making them available for download.
  9. User Responsibilities
    1. The user assures that they have all necessary rights to the uploaded files and that these files do not infringe upon the rights of third parties.
    2. The user agrees not to upload any content that violates applicable law or public morals, in particular, illegal, defamatory, or copyrighted content without the permission of the rights holder.
  10. Availability of the Tool
    1. The operator strives to make the tool available without disruptions. However, no guarantee is given for uninterrupted availability.
    2. The operator reserves the right to modify, extend, or discontinue the tool at any time without prior notice.
  11. Limitation of Liability
    1. The tool is provided "as is" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The operator makes no representations or guarantees regarding the functionality, accuracy, or reliability of the tool.
    2. The operator is not liable for damages arising from the use of the tool, unless they are due to the operator's intentional misconduct or gross negligence.
    3. The operator assumes no liability for the loss of files or damage to files that may occur through the use of the tool. The user is responsible for making backup copies of their files.
  12. Data Protection
    1. The operator undertakes to comply with applicable data protection regulations and to process uploaded files solely for the purposes specified in these T&Cs.
    2. The platform uses SSL encryption (HTTPS) to protect sensitive data.
    3. Further details on data processing can be found in the Privacy Policy.
  13. Changes to the T&Cs

    The operator reserves the right to change these T&Cs at any time. Changes will be published on the tool's website. Continued use of the tool after the publication of changes constitutes acceptance of the revised T&Cs.

  14. Final Provisions

    If any provision of these T&Cs is or becomes invalid, the validity of the remaining provisions shall not be affected.

  15. Special Provisions for ECU Modifications

    The modification of ECUs (Engine Control Units) using this tool is strictly limited to use on race tracks and for testing purposes only. It is explicitly prohibited to use modified ECUs on public roads or for any purposes that violate applicable traffic laws. The user is solely responsible for ensuring compliance with these restrictions.
